Terms of Service

WHEREDITGO Public Library

1. Acceptance of Terms​

WHEREDITGO Public Library ("WHEREDITGO," "we," "us," or "our") provides website-building tools, hosting infrastructure, subdomain routing, and directory services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms of Service ("Terms").

If you do not agree, you may not use the Service.

2. Nature of the Service​

WHEREDITGO provides infrastructure that allows users to:

  • Upload files and metadata
  • Generate static websites
  • Host those sites on AWS-backed infrastructure
  • Serve content via content delivery networks
  • Link external sites
  • Use optional WHEREDITGO subdomains (e.g., artist.whereditgo.diamonds)

WHEREDITGO operates as a passive service provider of user-generated content.

WHEREDITGO:

  • Does not pre-screen user content
  • Does not monitor content for legality
  • Does not verify ownership of uploaded material
  • Does not endorse, curate, or publish user content

Users are solely responsible for all content they upload, host, or link.

3. Eligibility​

You must be at least 13 years old to use the Service.

If using the Service on behalf of an entity, you represent that you have authority to bind that entity.

4. User Content and Responsibility​

You represent and warrant that:

  • You own or have the lawful rights to distribute all content you upload, host, or link.
  • Your content does not infringe intellectual property rights.
  • Your content complies with applicable laws.

You agree not to upload, host, or link to:

  • Copyright-infringing material
  • Unauthorized DJ mixes containing unlicensed third-party works
  • Malware or malicious code
  • Content unlawful under U.S. law

WHEREDITGO assumes no responsibility for user-submitted content.

5. Hosting Services​

WHEREDITGO may host user-generated static sites on AWS infrastructure, including but not limited to storage services and content delivery networks.

Users understand and agree:

  • Hosted content may be publicly accessible.
  • WHEREDITGO does not guarantee uptime, availability, or data retention.
  • Users are responsible for maintaining their own backups.
  • Removal of content may not immediately remove cached versions from content delivery networks.

WHEREDITGO may suspend or disable hosted content at its sole discretion for legal, technical, or risk-related reasons.

6. Subdomains​

WHEREDITGO may provide subdomains under its root domain.

Use of a WHEREDITGO subdomain:

  • Does not create ownership rights in the domain.
  • Does not imply endorsement.
  • May be revoked at any time at WHEREDITGO's discretion.

7. External Site Verification​

Users may submit external site links for inclusion.

WHEREDITGO may perform limited review to confirm:

  • The link is functional.
  • The site is structurally compatible with platform requirements.
  • The submission meets technical criteria.

This review is strictly technical and administrative in nature.

WHEREDITGO does not evaluate:

  • Ownership of content
  • Intellectual property compliance
  • Licensing status
  • Legality of external content

Approval for linking does not constitute endorsement, certification, or verification of rights.

Users remain solely responsible for all external content.

8. No Duty to Monitor​

WHEREDITGO has no obligation to monitor, review, screen, or investigate user content.

Failure to act in one instance does not waive the right to act in another.

9. Intellectual Property License​

Users retain ownership of their content.

By uploading or hosting content, you grant WHEREDITGO a non-exclusive, worldwide, royalty-free license solely to:

  • Store
  • Cache
  • Display
  • Transmit

content as necessary to operate the Service.

No ownership is transferred to WHEREDITGO.

10. DMCA Compliance​

WHEREDITGO operates as a service provider under 17 U.S.C. §512.

Upon receipt of a legally sufficient copyright notice, WHEREDITGO will:

  • Remove or disable access to the material.
  • Notify the affected user.
  • Accept legally valid counter-notices.

WHEREDITGO does not proactively monitor content for infringement.

Users who repeatedly infringe may have their accounts terminated pursuant to the Repeat Infringer Policy.

11. Disclaimer of Warranties​

The Service is provided "as is" and "as available."

WHEREDITGO disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability
  • Data integrity

WHEREDITGO does not guarantee:

  • Continuous uptime
  • Error-free operation
  • Data preservation
  • Immediate removal from CDN caches

12. Limitation of Liability​

To the fullest extent permitted by law, WHEREDITGO and its members, officers, affiliates, and agents shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits
  • Loss of data
  • Third-party claims arising from user content

WHEREDITGO's total aggregate liability shall not exceed $100 USD.

13. Indemnification​

You agree to indemnify and hold harmless WHEREDITGO and its members, officers, and affiliates from any claims, liabilities, damages, losses, and expenses arising out of:

  • Your content
  • Your use of the Service
  • Your violation of these Terms

14. Termination​

WHEREDITGO may suspend or terminate accounts or hosted content at its sole discretion, including for:

  • Legal risk
  • Repeat infringement
  • Abuse of infrastructure
  • Violation of these Terms

15. Modifications to Terms​

WHEREDITGO may modify these Terms from time to time.

For material changes, users may be required to affirmatively accept updated Terms before continued use of certain features.

Continued use of the Service after changes take effect constitutes acceptance.

Archived versions of prior Terms may be maintained for record purposes.

16. Governing Law​

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising from these Terms or use of the Service shall be brought exclusively in the state or federal courts located in Dallas County, Texas.

Users outside the United States acknowledge that their data may be processed in the United States.
